Ohio Teacher Gets Felony Convictions for Showing Graphic Movie in Class

 
 

 

A former high school substitute teacher in Ohio has been convicted of four counts of disseminating matter harmful to juveniles by showing movies featuring graphic violence and explicit sex scenes.

In 2013, authorities at Columbus, Ohio’s East High School caught substitute teacher Sheila Kearns showing the movie The ABC’s of Death. The movie was immediately confiscated and an investigation begun.

The low-rated movie, a 2012 anthology made up of 26 short horror vignettes by directors from 15 different countries, features explicit sex scenes and graphic horror stories. The theme of the film follows the alphabet with the title for the first story starting with the letter “A” and each additional story taking the next letter in the alphabet.

Kearns was charged with knowingly showing an explicit movie to her students but denied that she was aware of how hardcore the movie really was.

During the trial, several kids testified that the classroom was “going crazy” during the movie, and some felt it was “disturbing.”

A jury agreed that the teacher was not initially aware of how graphic the movie was, but after viewing the film themselves, jurors still found her guilty of exposing the kids to inappropriate content.

One juror told the Columbus Dispatch that watching the movie was “challenging” and that “nobody enjoyed it” in the jury room.

Further, investigators said that the teacher didn’t seem very concerned when confronted about the movie.

Lolita Perryman, a detective from the Columbus Police Division’s exploited children’s unit, said that Kearns dismissed the film saying, “Those kids see worse than that at home.”

Judge Charles Schneider set sentencing for March 4. Kearns will likely get probation for this first offense but could get a maximum of 1 year in prison and a $2,500 fine.

The substitute teacher was fired from the school district in June of 2013.

OK, this is just dumb arse stupid on her part. However, fire her, send a letter to the teacher licensing board but do is this really worthy of using the court system for criminal charges? I don't know.

Oh please, they watch that crap at home or at friend's houses. When my kids were LITTLE , they would say "oh yeah, I saw this or that R movie". And, I hadn't taken them to those movies, so yes they were watching that at other people's houses. I think she is a stupid dumb arse. And, I would have wanted her fired on the spot and reported her to the state board, but I don't know if we need to criminalize all stupidity.

 Oh please, yourself.  You realize sexual predators groom their victims showing porn to kids? If it was just violence - I'd agree with you - but explicit sexual content - NO.  Who knows, maybe she was getting her jollies off showing sex to kids.  This was in SCHOOL, and shown by a teacher - it makes it look sanctioned.  Kids may watch that stuff with their friends, but most of them know they shouldn't be.  If they couldn't walk into a theater a watch it without parental consent, they certainly shouldn't be watching it at school.

And sorry -the fact that your kids could get away with watching rated R movies when they LITTLE does not help your argument.  If my kid watched a rated R movie when they were little somewhere - it would be the last time they went to that person's house.

Ok. Just a little objective observations.

These are high school kids. Not 10 year olds.

Was it the sex or the violence that was the real problem?

Faces of Death anyone?

1000 ways to die?

Slasher flicks of any kind?

So it probably wasn't the best choice for a classroom.

But yes, by 14 most kids have seen some kind of scary movie, know about sex and understand that sometimes the two merge.

I remember those Faces of Death movies when I was in school. Very disturbing, even now the memory of it can creep me out.

Heck, watch a music video.

I do see a double standard. People don't see what a kid is doing in their own home but get all bent out of shape when it happens in school.

A lot of schools use substitutes that are not licensed teachers - they are just people with a degree in anything. I wonder if this was the case here? It doesn't excuse the behavior, but it could explain why going to the licensing board won't work.

I'll agree with Lily. It was inappropriate and she should be fired and prevented from getting another teaching job. But criminally charged?

I remember those Faces of Death movies. Creepy is an understatement. And at that age, it was a "tradition" to see those Friday the 13th movies every Friday the 13th. Then we'd drive into the hills and work ourselves up to being terrified at every little noise.  <sigh>  Fun times.

I remember those Friday the 13th movies. And I remember after the 5th or 6th one, a local theater had an all night movie marathon.

You bought a bulk ticket, I think it was about $20 and then you spent the entire night watching the movies. It was a lock in type thing. The lobby was made to look like Crystal lake and they even had a "Jason" in a casket that you had to walk by to get in. He would grab at people and move and do all kinds of creep y things.

Then during the movie he would come in at different points and scare the poop out of you. He would settle into the seat next to you and just wait. Get in line behind you at the concessions or the bathroom.

The girls bathroom was the ONLY place you could go and be sure he wouldn't be there.

It was huge fun. We have a page in one of our year books that talks about those movies. It was extremely popular.

I think people try to over protect kids at school but pay no attention to what they are doing in their rooms.

When DD was in 4th grade she had to do a report on a state. She chose Hawaii. She wore a grass skirt and a lei when she presented her report. Her great grandma had been to Hawaii and had a video from the travel agent so DD showed it in class. The teacher put it on and stepped out of the room for a second. While she was out of the room...bare boobies on the screen. Someone sunbathing without a top on nice and close up. DD was humiliated but the kids thought it was awesome. No one told the teacher and no parents complained. Thank goodness.

 Good point LL.  However,  I completely agree this was WRONG and about as stupid as stupid can be.  However, I really don't see that everything needs to rise to a criminal matter involving the Police and criminal justice system.  I think I would rather see my tax money being spent prosecuting violent crimes and things like that.

I have to wonder if this was something the sub brought or if it was on the list of approved movies.

Most subs are left a movie or two to show when a teacher is out.

There are lots of movies on the approved list that never cause a problem until they do.

I remember watching real footage from WWII and concentration camps. That freaked me out more than you know.

Sex can be embarrassing to watch with others in a class situation. I remember health class and "the movie" we were shown in 8th grade and again in 9th. Goodness and the day we walked in class and each desk had a banana and condom on it was incredibly embarrassing.

Lots of things happen in school. Kids see and take part in a whole lot of things.

 No, Lily - if the movie had been provided by the school and on their approved list - no charge would have even been brought. 

 

The class was Spanish.  I can't even comprehend the thought process that went into her selecting that movie for kids over say.....Shark Week.

 There is absolutely NO ALLEGATION that this was on the school's approved movie list.  NONE - and that would be pretty central to her defense.  You are grasping for some unknown reason. 

 

Go click that link I provided.  There is a preview for the movie - you have to enter your birthdate to view it.

 

As for Pretty Woman - I watched it along with several others in a film studies class to discuss the changing roles of women in society and how films react or do not react.  And if you look at the approved list on the link you provided - it will show that Pretty Woman is approved only for certain clips - not the entire movie.

l also looked it up on youtube. It is a compilation of short stories a lot like the 1000 ways to die that is shown on TV. It is a combination of cartoon, clay mation, and movies.

The quality of bad SciFi and B list scream movies.

Saw was worse than the clips I watched.

 Yep.  Saw all those movies.  But not in school.  And of course, I had an alcoholic mother who didn't understand the concept of parental supervision - so I don't base what I got away with as the model for my own parenting.  And I do not recall explicit sex scenes in them, either.  This isn't Halloween.  A kid would not be allowed in a theater to see it even WITH an adult and it was shown in schools by a substitute teacher. 

Did you watch the 17+ trailer, yet?  C'mon - if it's no big deal for the kids to watch the actual movie - why can't you watch the trailer?

When I was in high school they showed Zefirelli's Romeo & Juliet.  There was nudity and sex in it.  But that scene was cut before it was shown.  Parents were outraged (Not mine).  I worked at the School District switchboard and the Superintendent's phone was blowing up.  Parents assumed since they saw Zefirelli's R & J that it was shown in its entirety.

We also saw Yellow Submarine and parents were outraged at that.  Not sure why.   

These movies were shown not necessarily for literary value or education, but because the temps were in the high 90's low 100's and the only two rooms at the school that had A/C were the movie auditoriums.   It was way to keep students from getting heat strokes.

 Wel, according to the teacher, she didn't know what was in the movie, even though she showed it FIVE times.  So, it's unlikely.  Especially since the jury found her guilty just about immediately - no deliberation necessary.

And I seem to remember some pretty graphic sex scenes in Friday the 13th and Nightmare.

I still don't know what the sex bothers you more than the violence.

Honestly, I think it shouldn't have been shown because of the violence.

But while I wouldn't think it should e shown in school, I can see these kids watching it on their own.

I wonder how many of them and how many since this article and case have watched it on their phone.

Should it have been shown in class? No.

Does it deserve a criminal charge or conviction? No.

 Really?  Violence is all over network TV these days - have you seen The Walking Dead?  Sex is not.  Yes, I think showing explicit sex scenes to kids in school is worse than showing violence.  Both are bad, of course, but one is worse.

And I'm not talking about the youtube version.  I'm talking about the link I provided with the 17+ preview. 

This is an unrated film that no child would be allowed to view even with a parent, and yet it's ok that a teacher showed it in school?  It's basically got porn in it, Lily.

 Well, an entire jury disagrees with you after viewing that film.  And they disagreed QUICKLY. 

Again - violence?  She gets fired.

Sex?  She gets convicted of showing inappropriate material to juveniles.  As she should.

Was the sex in one story?

I will never understand why sex is a problem but someone being cut in two with a chainsaw isn't.

Sex happens. It's an every day part of life in most homes around the world.

Do we display it in the living room? No.

But violence. Now there is something we cant seem to get enough of.

I am not, have not, and will not ever think it was ok to show this movie in class.

Show me where I have said otherwise.

 Well, no one is saying it wasn't both here.  I have my concerns, the parents had theirs, and the jury obviously had theirs.  Some are more concerned about the violence, some about the sex.  Neither was appropriate - but it's the sex that gets you convicted of showing it to kids.
