Stealing the "likeness" of another (without consent) for commercial use is prohibited and not protected under the First Amendment. It might be different in your country, but that's how it works here.
According to an article I read, he's pursuing the commercial misappropriation angle. I wonder, if he went with the "false, misleading, or deceptive speech" route, if he'll have to "prove" the falsity.

My feeling exactly. Don't give the artist any free publicity for her work. Just ignore & the painting will be worth nothing.
I don't know, this is somewhat like posting nude photos with permission. Even though it is a painting and not a photo, I think it should be destroyed.
It's not a photograph. It's a painting. Should we eliminate all the cartoon drawings of him too? Yeah, it's rude and uncomfortable which is the point, but it isn't HIM. It's just a painting. So you destroy it and then what? How hard would it be to paint another ? Bobwhathisname can do a full painting in a half hour on pbs.
