An Oregon couple used Facebook to seek justice for their one-year-old son, allegedly beaten and bruised by his babysitter. The sitter was finally charged after an Oregon community and countless social media users demanded action from officials.

After receiving an inadequate response from local law enforcement, Alicia Quinney and Joshua Marbury posted a heartbreaking picture of their badly bruised son, Jacob, on Facebook. The couple said they took the photo after they returned home to find him on the floor crying, while his babysitter, Markell Hilaire, was asleep.

“The first thing I saw was Jacob’s black eye,” Quinney told. “And I was like, ‘Oh my gosh, what happened?’ And he turned over and the whole side of his face was black and blue.”

Quinney and Marbury rushed little Jacob to the hospital, where he received treatment for his injuries. The doctors and social workers took statements from the couple, documented the child’s injuries, and photographed his scars. Upon leaving the hospital, Quinney and Marbury went to the Sherwood Police Department to file an official report.

The couple’s abuse case was placed under investigation and was turned over to the Washington County District Attorney, a Sherwood Police Department spokesman said.

Two months passed, and the couple had not seen any action from local law enforcement. The authorities elected not to arrest Hilaire, citing an obscure legal loophole.

This prompted Marbury to post the photos of his battered child on social media.

He wrote on Facebook:

After several days if not week of being distracted at my job (only commission sales job and only source of income) we had a confession from the abuser saying they did it. STILL this person was not arrested because they had to build a case and a jury to find him guilty BEFORE they go to jail. Side note if I’m not mistaken (if I strike a person in the face and the cops were called I would be put in hand cuffs immediately). After TWO months of waiting we only find out that charges are dropped BECAUSE my one year old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person “intentionally” did this.

The horrific photos showing little Jacob’s abuse went viral, being shared more than 400,000 times. The Facebook post eventually led to the Washington County district attorney’s decision to charge Hilaire with criminal mistreatment and assault.

“Although charges were filed in this particular case, the need to fix Oregon law to protect vulnerable victims remains,” the prosecutor’s office told KPTV in a statement. “Under current Oregon law, animals are more protected from physical injury than many children.”

Evidently the hands of the authorities were tied by the law until there was enough outcry to make an exception....... The laws are not always as complete and/or adequate as they should be.

I have zero sympathy for child abusers. None.

I think some cases should receive the death penalty.

There was some kind of law that said a victim had to be able to name their attacker for an arrest, and since babies can't talk.....

It was stupid and I'm glad they have arrested him, I just hope that stupid law doesn't get it dropped.

If a parent had injured their child like that, the child would have been removed from the home and the parents would have been charged with child abuse. What makes the babysitter immune?

I would have beaten the crap out of that babysitter.

I was wondering the same thing Czech.  Or do parents get away with child abuse in Oregon until the kids are old enough to speak?

My dad would have beat the snot out of him if he did that to one of us.

I had a friend once tell me that she wont leave her kids with anyone she wouldn't let borrow her car.

My kids had a teenage boy as their babysitter one summer. He was very good and even cleaned the house for me. He is now working for our business. The picture of that little baby boy breaks my heart. He looks so pitiful and sad that his innocence has been tampered with. I hope the babysitter gets beaten up in jail.

Oh Lindley ~ don't worry - cons HATE child abusers. They will do more than beat him up - he will become a very accident-prone prisoner. And the law needs to be amended.

   Well, people say "just hire a babysitter" in a very flippant way as if that is always an easy thing to do.  We live in a town where we have no family or relatives.  And, everyone we know is already working so not so easy to find a sitter.  And, the people we do know have kids the ages of our kids so there weren't a lot of teen sitters we knew when they were little.

  As for hiring a male, i am not saying i would never hire a male.  I am saying that I preferred female sitters, especially for small infants.  And, i doubt i would hire a teen boy to watch a baby.  Older kids, maybe if it was someone i knew and trusted.

It takes a lot of patience to deal with a crying child, no matter what the sex of the parent is.

Not EVERY woman should have children. It doesn't mean they aren't "real" women.
