An unarmed Florida therapist was shot by police while trying to calm down his autistic patient, authorities said.
Police in North Miami were responding to a report of a man with what appeared to be a gun when they came across Charles Kinsey and his patient, who had run away from a group home.
'All he has is a toy truck — a toy truck,' Kinsey pleads with cops, lying flat on the ground with arms raised, as seen in cell phone footage of the incident. 'I am a behavior therapist at a group home.'
Kinsey tries to get his patient to comply, using soothing words so he remains calm.
'Rinaldo, please be still, Rinaldo,' he is heard saying in video released by WSVN. 'Sit down, Rinaldo. Lay on your stomach.'

The man, 23, sits next to him and yells 'shut up' while playing with his toy truck.
'Don't shoot me,' Kinsey begs.
An officer then fires three times, striking Kinsey in the leg, authorities said.
No weapon was found.
Kinsey is black. Police haven't released the name or race of the officer who shot him.
Kinsey, 47, says the 911 caller must have mistaken a toy that the autistic man had for a gun.
'I'm like this right here, and when he shot me, it was so surprising,' Kinsey told WSVN.
'I thought it was a mosquito bite, and when it hit me I had my hands in the air, and I'm thinking I just got shot!
'And I'm saying, 'Sir, why did you shoot me?' and his words to me were, 'I don't know.''

Kinsey was taken to a local hospital with bullet wounds to his legs. He is expected to go home later this week
After the shooting, Kinsey and his patient were patted down. Kinsey was cuffed.
'I was really more worried about him than myself,' he said of his patient.
'I was thinking as long as I have my hands up, they're not going to shoot me.This is what I'm thinking, they're not going to shoot me. Wow, was I wrong.'
North Miami police has placed the officer on administrative leave for at least a week,' the Miami Herald reported.
Kinsey's lawyer, Hilton Napoleon, said he is in talks with city officials about a possible settlement.
'They realize this was something inappropriate regarding the shooting,' Napoleon told the Herald.
'If police departments come out more and admit fault, that would probably go a long way.'
Kinsey is expected to recover and go home later this week.
Accidental firing? The cop said he didn't know why he shot. And he took it in the leg. Had it been intentional, wouldn't he be a dead man? And why were the police suspicious of him anyway? And who is videotaping this whole thing...from various angles?
Personally, I always thought they needed more legal training. They go on gut feelings a lot and fail to follow procedures, permitting evidence to be thrown out of court, etc. A good defense attorney can poke holes too easily. On the flip side, those cops with more legal training/education, etc., rise up the ranks and don't stay on the streets long. And they aren't the ones making these rookie mistakes. Kind of a catch 22, if you will.
One of the pictures looks like it may be from a home security camera.
The others may be from body cam's.
This article is frightening. Dealing with handicapped adult children is scary enough without having to be worried about being shot by a cop while trying to help your handicapped adult child.

Wow, this is just crazy. The police just needed to stay calm & listen to what the man was saying. This could so easily have been avoided. I'm glad it just got his leg. He sounds like a very caring therapist.

Don't be so quick to judge. There are a lot of holes in the article. I bet it will come out the cop was justified. And not enough training? I don't think that is the case here. The cop shot the guy in the leg. That is what is supposed to happen.

From what I've seen on the video this is definitely bad for the cop. The guy was sitting on the ground with his hands in the air telling them what was happening and they still shot him. I am usually on the side of the law but in this case they were wronger than wrong.

Besides being unable to stay calm or listen, the cop who shot this guy also has terrible aim.
ETA The bad aim part is fortunate for this gentleman. Although I am sure he would have preferred not to be shot at all.

I guess that many police are on high alert. I wish everyone would just calm down.
I'm watching the news and a supervisor is saying he thought Kinsey was in danger and meant to hit the patient. Regardless he had no reason to shoot anyone.

Heck, years ago I was leaving a guy who had guns in the house and I called the police for protection because the guy suddenly came home (someone tipped him off I was moving out). Anyway, they put me in the back of the squad car, where I remained until they could make sure the situation was under control. I didn't mind, it was a hot day and the cop had his A/C running so I was quite comfortable.

Saying you were attempting to shoot the autistic boy who was playing with a toy truck instead isn't much of a defense IMHO. Makes the cop look worse to me. Aside from shooting an autistic boy posing no threat, if the cop has aim that poor, he needs his gun taken away from him.

I agree. That was a terrible defense. This cop should have his gun taken away for a few reasons.
Just going to wait for more information to come out.
I actually have to agree here. When I first read this story I said, "Nothing about this makes sense." More and more often we are getting quick one sided stories and then after the investigation is done there is a lot of information people don't know. I'm not on either side but I want to wait to find out all the details.

Name one police department in this country that trains their officers to "shoot the suspect down without killing them".
Cops are paid a pittance. You are not going to get the brightest of the bunch for such a dangerous job that pays crap.
How is this an excuse? They accepted the job. I expect they are trained to do the job. That means learning how to be cool and rational in situations and not flipping out and gunning down the public.

They are minimally trained. A couple of weeks and then put on overnight shift.

I trust the Police as well. But, there have been egregious cases. I think Eric Garner was way over the top. That's my opinion. There have been citizens shot whom the cops screamed at to show their registration, then when they turned to get it, they shot them. There have been egregious cases where they tased a Naked Mentally ill woman over and over until the point of death. Do you think that if i tased you, that you would instantly be able to comply with a police command? If i was suffocating you, would you struggle to breathe and therefore 'resist arrest". It is out of control.
I guess I should have caused a fuss when I got bruised and bloody while on the ground, cop on my back.
But I didnt.
Why?
Because I set those events in motion.
Sorry, it's very, very rare an innocent person is hurt by the police.

OK? I support the police. If i ever get pulled over, i would do exactly as they say in a respectful way. However, just because i don't pretend there are no bad apples doesn't mean i don't stand in support of them. They were absolutely right in the case of Michael Brown and many others. However, there are some cases they have been absolutely wrong on as well. I won't support that.
