So when I bought my car I was told that one benefit that this dealership gives to buyers of new BMWs is if you have a need for auto body in the first year and bring it to them for repair they pick up your Insurance deductible. I totally forgot about that.
When I picked up my car last night, the cashier said I didn't owe anything because they picked up the deductible reminding me of their policy. So the other insurance company has not paid up yet, I know it can take months. I have collision on my car so my insurance company paid for the repairs minus the deductible. So my thought is the other insurance company nor the person who hit me shouldn't profit from my benefit for choosing to buy my car where I did. After all, that "paid for" deductible is somehow incorporated into the price of the car. Can I still push for the deductible even though I didn't "pay" it?

I don't know the "right" answer. But, when I got hit a while back, the guys insurance looked at my car and cut me a check. The actual repairs ended up being less than they paid. I just kept the difference.

Well you should be able to get the appropriate amount to make you "whole" again. If you can find the repairs for less then that is due to your vigilance. And that is what I am getting at. That little wench owes me!!!!!!!!!!!!!

So now I really need the advice of an insurance person. I went out to get my mail. There was a check for $400 from my insurance company, the amount the other insurance company paid toward my deductible. This means I am being held 20% responsible. Not going to happen. It is off business hours so can't reach my insurance person.

Here's the thing - if you get into another accident, are they going to waive the deductible again? Think of what they did as a gift certificate that had one use.

The 2 companies fight it out. If you are not at fault you should get the deductible back. God, the others persons insurance wasn't GEICO, was it? Let me know. And I'll explain.
Oh, yeah. Now I remember. Yeah, no wiggle room with that. I'd call your insurance claim rep. Just check in and ask where they are at. She'll say the same thing, but your just moving it along.
GEICO stands for Government employee Insurance company. founded 100 years ago or so, kicked out about 40 years ago, making a comeback with that gecko guy.

Sadly, yes. They fight with every body shop. If your bumper got hit? They don't want to replace it with a new bumper. They want the shop to find you a used one. They will not pay for new. They also try to get out of paying if you are at fault. This will cause major stress. 24/7 the other Company will call you.
I have 2 clients battling with Geico right now. They are refusing payment/ Luckily their own policy paid and their Insurance Company will fight GEICO.
