Mom films autistic 10-year-old’s arrest at school. Then he spent the night in jail.

A Florida mother filmed the arrest of her 10-year-old son as school resource deputies handcuffed him and took him away.
The boy, who has autism, is accused of battery of a school employee in Okeechobee County because he kicked a teacher last November. The offense is a third-degree felony.
His mother Luanne Haygood said her son shouldn’t have been arrested for the incident.
“It was because of his autism that spurred this incident,” Haygood told WPTV. “And he was arrested for that.”
In the video, which Haygood recorded on her cell phone, her son John Benji Haygood is heard as officers place handcuffs on his wrists.
“I don’t want to be touched. Please don’t touch me,” the boy says in the video. “I don’t know what’s going on.”
Haygood said watching her son be cuffed and put in a law enforcement vehicle “broke her heart.” She said the 10-year-old boy then spent the night at a juvenile facility in Fort Pierce, Florida.
Although the incident took place last year, deputies said they couldn’t serve the arrest paperwork until last week.
Haygood said her son had prior behavioral issues because of his autism, but said that there needs to be a different way to deal with him.
“Unfortunately, instead of treating or accommodating we arrest because we don’t know what else to do,” Haygood said.
The sheriff’s office and prosecutors told WWLP that they weren’t aware the 10-year-old had autism, and the state’s attorney said it will be taken into consideration as they look at the case.

OK - this crap is getting ridiculous. He's 10. He's autistic. If schools are going to mainstream special needs students, then make sure teachers and administrators learn how to deal with them.
And police should not be called except for extreme circumstances, even with non- special needs students. Schools need to learn how to properly discipline again.

They waited a year to arrest him? That in itself is wrong. Isn't there a SOL for this sort of thing?
As wrong as this all seems, if this were to occur to my boys, the last thing that would come to my mind was to get it on film. I would be spending my energy making sure my son understood that he was going to be okay and that I was getting him help so he could return home, not standing there with my cell phone up. Not that having the incident recorded was a bad idea (on the contrary), it's just not something I would think of to do in such a situation.
Makes me wonder if there is more to the story. The whole thing seems off. Arresting someone a year later? I don't get it.
But, part of the problem is that schools cannot really discipline anymore. They can't spank anyone. In my day, i recall the Principal literally slamming a kid against the wall. Not advocating that, but we all towed the line. However, now that we have to make schools take a completely hands off approach, the Police are now getting involved in things that Police would have never gotten involved in before. It's idiotic.
Not sure she has a right to be filming the other kids in the school who may have been there. Not sure I would be happy about that if my kid was a bystander.
But, yeah, everyone can sue, sue, sue the School. Why not. But, if you want to destroy your educational opportunities for the other kids and make some point and devastate the community, then by all means sue. And, the Police are the ones who decided to arrest, that is really the school's prerogative. If they issue a warrant to arrest him , there is nothing the school can do about it. In reality, the teacher has probably been assaulted over and over and felt that was the only recourse. Of course that fault then lies with Admin for not offering proper ways to deal with this child and protect the teacher.

I'm a bit torn. I mean are the teachers supposed that minuet let the kids assault them? Definitely a cluster....
Teachers of special needs students need to be better equipped to handle things like this. And no, they shouldn't get kicked - but getting kicked should not become a criminal matter for a 10 year old autistic child.

Ok. I'm going to say it, as a mom with an autistic child, I feel it gives me a different angle looking at these things.
Autism comes in so many varying degrees, it really is not possible to meet all the needs, all the time.
There are melt downs, acting out, and unrelated behavior.
BUT there are simple things that can be taught, even to the most severe.
A lot of the behaviors of autistic children is repetitive habit, and they can learn to control themselves.
Hitting, kicking, biting. A parent, and teachers, can teach them not to ever do those things.
Jesse was beginning to express some hitting at one point, but he learned that he had to control that.
It wasn't easy, it was really hard for a while, and I had to be super vigilant.
I firmly believe a lot of the "symptoms" of autism can be stopped.
I mean, you dont allow crab grass to grow hoping it learns to stay out of the flower bed.
I had to fight to get the special needs teachers to stop just letting Jesse do whatever he did.
As for the OP, a year later for the arrest is weird.
But why didn't mom bail him out?
What has been going on for the year?
It says he has behavioral issues, what does that means?
What has been done to control or stop the issues?
Something is fishy with the story, but what's mom, and dad if he is around, been doing to teach their son how to function in the world?

I'm also wondering why he wasn't arrested when it happened? Seems that would have been a good cause and effect teaching moment. But a year after the fact? That's pointless.
My friend is a domestic violence counsellor. People think that means that she works with kids who have behavioural issues at home. This morning a call came in with a referral because a little boy (6 yrs) was calling his teachers 'mean' and called the principal 'mean' and didn't do what he was told. Yes, the child was in the midst of violence between his parents when an infant and has a trauma response but a referral because he called a teacher 'mean'?
My friend is a domestic violence counsellor. People think that means that she works with kids who have behavioural issues at home.
