Teenager died after eating burger despite telling staff about his allergy, coroner rules

London(CNN)A teenager who died after eating a birthday meal at British burger chain Byron had told staff about his allergy to dairy, but was misled into thinking his order was safe to eat, a coroner has found.

Owen Carey, who was celebrating his 18th birthday at the restaurant in 2017, told waiting staff about his allergies before ordering a fried chicken burger coated in buttermilk at a London branch of the restaurant.

But he was reassured by the menu and told the burger was suitable, the UK's Press Association (PA) reported.

Carey suffered an allergic reaction soon after eating it and died within an hour.

"The deceased made serving staff aware of his allergies. The menu was reassuring in that it made no reference to any marinade or potential allergenic ingredient in the food selected," coroner Briony Ballard concluded in a written statement, read at Southwark Coroner's Court during an inquest on Friday.

"The deceased was not informed that there were allergens in the order. The food served to and consumed by the deceased contained dairy which caused the deceased to suffer a severe anaphylactic reaction from which he died," the statement added.

Outside the court, Carey's family appealed for a change in the law to prevent similar incidents in the future.

"Owen was the shining light in our family. We are calling on the Government to change the law on allergen labelling in restaurants," his family said in a statement reported by PA.

"We want restaurants to have to display clear allergen information on each individual dish on their menus. The food industry should put the safety of their customers first," it added.

"It is simply not good enough to have a policy which relies on verbal communication between the customer and their server, which often takes places in a busy, noisy restaurant where the turnover of staff is high and many of their customers are very young."

PA reported that the verdict was attended by the parents of Natasha Ednan-Laperouse, who died at 15 after eating an unlabeled sesame seed Pret a Manger baguette in 2016.

In a statement, Nadim and Tanya Ednan-Laperouse called Friday's verdict a "landmark judgement," adding: "We have heard remarkable parallels between Owen and Natasha's death. Owen's death yet again highlights the inadequacy of food information in this country."

Byron is one of Britain's most popular burger chains, with 35 restaurants in London and several others around the country.

Its CEO Simon Wilkinson extended his "deepest condolences" to Carey's family in a statement. "It is a matter of great regret and sadness that our high standards of communicating with our customers were not met during Owen's visit," Wilkinson said.

"We believe that Byron always did its best to meet our responsibilities, but we know that this will be of no comfort to Owen's family," he added.

This is tragic.

When I worked in the restaurant business, and someone made an allergy known, I personally made their food.

I'd change my apron, wash my hands and arms, put on special gloves, cover a surface away from the allergy food, and use clean tongs or spoons to prepare their food.

However, I remember a couple that came in, they both ordered, then the woman asked if we served shell fish. I said we did, both shrimp and calms.

She asked if I could say there would be no contamination.

I couldn't promise that. We were a seafood restaurant, I couldn't sanitize the entire store, she became rather annoyed and loud.

But what was she expecting? She walked into a restaurant where, even if I could promise there would be no contamination behind the counter, I couldn't promise there would be none in the dining room.

Most fried chicken is "marinated" in buttermilk. I am surprised he didn't know this. Still the restaurant should have advised him if he told them he had a lactose allergy.

I haven't heard a lot of dairy allergies that were anaphylactic in nature. If that was the case, he should have had an epi pen at all times and not wise to eat out.

There are different kinds of allergy. My son has celiac's but that is not an anaphylactic type of allergy. I think part of the problem is that allergies that cause symptoms of gi upset, etc are confused with allergies that cause your throat to close and the risk of death. Peanut allergies are often of that nature versus a the gluten problem that my son has which is more GI related.

In any event, of course restaurants should know what is going in to their food and should not serve foods to those with problems. But, as you can see, you really cannot trust anyone, which is sad.

Exactly.  That is the absolute right thing to do as you made her aware.  Silly for her to be annoyed when that is something on your menu.

I do like the wanting to put ingredients of the dish on menus. It might make menus huge, but I'd like to know what's in dishes I order, too.

Not sure how I feel about this. I get the customer was informed wrong about the ingredients and that is really bad. But this is a burger place which usually employs teens / young adults. Their training was not good apparently. But when someone has a deadly allergy they are begging for trouble if they are not carrying the epi pen or some other medicine. The allergy is to dairy and so many foods contain dairy. What about the bun for the burger? Eh I am sure the article doesn't contain all the details.

Yes.  I mean if you have a deadly allergy you need to be ultra careful and certainly have an epi pen.  And, not all food servers understand the severity of allergies.  On thinks allergy they think it's a rash or the sniffles or something like that.  I would not assume that servers in a burger joint have all that much knowledge of a potentially deadly medical condition.

My coworker has a son with a lot of pretty bad food allergies. When they eat out they will bring him something to eat from home. One time they were at chick fil a and the manager came over to speak with them and offered to personally cook for the boy and promised he would avoid any cross contamination.

As a parent, not sure i would be trusting anyone's promises.  I mean, they may truly mean well, but they don't necessarily know the intricacies of anyone's allergies.  Best not to take chances if one has anaphylactic type allergies.

Even though they are horrifically
expensive, I have an epi pen with
me at all times - purse, car, boat,
and house. I'm fortunate in that
my allergy is fire ant bites, and
not food.

How sweet that the manager would do that for him❤️. My Dil’s sister was born with I think is pku? She can’t eat any protein, her mom would always send with her her own food when she went to a friends house till she was older and knew what foods to stay away from.  I had a young boy in my SS class that was so allergic to anything wheat that his mom had to wipe down the grocery cart in case there is any wheat residue. He was Rushed to the er at least one because of a very bad reaction. They would always send with him his own snacks to have during childrens Church.

Too many people claim "allergies" when they simply don't like or don't want to eat something or on some fad diet. I mean, yes don't eat what you don't want too, but don't play the "i am allergic to gluten" game, etc if you really aren't. This has caused a lot of confusion among those trying to serve people.

My hospital cafeteria is terrible about cross contamination. I'd never get food there if I had allergies. They will serve shrimp and then stick the same spoon in another dish.

DD is gluten sensitive. She tries to avoid having it. Once we were at an Italian restaurant and she ordered gluten free pasta. They asked if she needed them to wipe everything down before cooking her dish. She declined since it's not an allergy.

Chic-fil-a uses highly refined peanut oil to fry their food. The refining process is supposed to remove the proteins that cause the allergic reaction, but their site still says to check with your doctor.

It is really kind of silly for a restaurant to offer some guarantee in that regard.

Our chick fil a uses separate fryers for fries and chicken.

Which is why they say check with your doctor.  I don't think their statement offers a guarantee of any kind.
