I believe the prosecutors would have gotten a conviction for negligent homicide. But not first degree.
And if they had been seeking life instead of the death penalty.

If this case is going to prove to be more than a media sensation then they need to make sure they are not waving the wrong banner.

Same with Zimmerman. If they had sought a lesser charge, he would be in prison too.

To me, OJ was guilty, and Zimmerman fired in self-defense. He's a jerk, but he was being beaten to death by a thug who punched him, knocked him down and was beating his head against the sidewalk. Probably, you or I would have shot him under the same circumstances.

I do agree that at trial the jury should have options.

Not evidence you don't, exactly, but there are holes in what the prosecution is saying that the defense will be able to use.

No one actually saw her running, or how much she ran, or whether she had any breaks, or not.

There may be some underlying medical condition which was alluded to in the article.

I have a nine year old SS and would gladly send him out to fetch or stack wood for three hours. BUT, and here's the difference, I would not make him run constantly. I might yell at him to "pick up the pace and stop being a slow poke or you'll be out there even longer..." but he wouldn't have to run constantly. Also, he'd be allowed water and pee breaks. BUT, and again here's the difference, if he pulled the crap like he pulls in school where he needs a drink and to pee every five minutes you'd better believe I'd cut that nonsense off. I'd give him a REASONABLE break. And quite frankly, the marks don't bother me. Kids get marks from all kinds of things. Scratches, scraps, and bruises. That's not a big deal. He does that playing.

Yes. Running a child until she vomits and seizures IS ABUSE. Why is that so difficult to understand?

I have worked my butt off my entire life. Calf chores at five, milking--with heavy ten pound machines--at nine. I am no stranger to long hours and physical labor.

Running three hours straight with no water and while carrying firewood would just about do me in. Your heart and muscles are working much harder when you run vrs walking.

How long can any of you run before you need to stop and catch your breath? A minute? Five minutes? Add a load to that, and make it a comparable one--Say the firewood was 10-15% of her body weight, and scale it up to match you. So, for most of you guys, it would probably be in the 20lbs range.

How long could you force yourself to run?

I cannot fathom someone saying this is not abuse. It is very clearly abuse. It is not at all the same as physical labor.

Doesn't matter. There's enough there to show grandma ran her to death, or at the very least showed grave depravity and negligence. The girl is dead. It's grandma's fault.
