"I think if a girl says "yes" - it's a yes even if she is drunk. And yes can be inferred by action - like passionately kissing and helping the guy undress. But, a girl that is passed out cannot give consent." - Lawyerlady

This is how I feel as well. "Yes" should still count, whether verbalized or inferred by action, even if you are drunk when you say it. Take responsibility for your actions.
Passed out, however, is NOT an invitation nor is it an "implied yes". Passed out should be an automatic "no". I would even go so far as to say that passed out still means stop, even if "yes" was said before the person passed out.

"Ok. Please let's agree that rape is wrong. Implying he will be raped in prison and he will deserve that, is wrong. Rape is wrong. RAPE IS WRONG.
I understand wanting revenge but I can't even fathom being ok with anyone being raped. Not even a rapist. And the logic of that is suspect as well. If you want him to be revenge raped, one night, 4 guys. This guy will be raped repeatedly for years and that isn't an eye for an eye." - voiceofreason

While I agree that rape is wrong, when someone commits rape, I believe they forfeit the right to complain if karma returns their actions to them, sometimes in multiples.
It appears that there may be a problem with this verdict. One of the jurers lied about a previous sexual assault. There may be a mistrial called on this.
So, I think if someone actually did lie to get in the jury, they need to be fined. The state will be incurring the cost of yet another trial.

What's being reported here is that the juror didn't lie, she was never asked the question. I'm waiting on the whole story...

precisely--am not responsible for what happens to him ( them ) in prison--their actions put them there, so be it
seriously doubt a motion for mistrial will fly--evidence of guilt is " photographic " and has been corroborated by the perpetrators themselves
