My thoughts are the bathroom/locker room you use should be based on the body you have, not the body you want. Much less confusion that way. That said, this gym has made it clear what their policy is, so anyone not comfortable with that needs to find a new gym.

But they didn't. Where did they inform their members about this transgender policy? It was only after she complained that she was told.

I can explain it to you, but I can't understand it for you.
Would it still be "private business" and "policy" had they made the man leave the women's locker room?
Depends on the laws there.
That isn't what I asked.
All the "it's a private business" stuff has been said before. But it is shot down because it doesn't fit the current agenda.

What are you asking then?
Private businesses have to abide by many laws. Being a private business does not let them avert laws. If there is a law that mandates the use of separate facilities for males and females then the gym should comply and make him use the men's locker room.

No, they didn't beforehand but after the incident they certainly did. That is what i was referring to. And I also think refunds should be given to those that choose to leave now that this policy has been revealed.

There is no law in Michigan restricting restroom use. However, the use of the wrong restroom does fall under "disturbing the peace". But if your license says "female" and you go in, do your business and get out, no one should have a way to challenge your use of the "ladies".
"The one thing that I would like to add is the Michigan's Equal Access law regarding public accommodations, does permit for separate bathroom facilities for males and females. I know that cities such as San Francisco permit bathroom usage according to state ID. I don't believe that Michigan has any specific policy regarding this. Probably the issue of the bathroom would have to be looked at on a case by case basis. I agree with you, that identification should be sufficient, but I know that's not always the case. The case law regarding this issue has been mixed. Certainly a transgender employee should have access to bathroom facilities that accommodate his/her gender expression/identity- be that a unisex bathroom or the gender identified bathroom facility." -- Jay Kaplan, ACLU lawyer.

I didn't know that using the wrong restroom is disturbing the peace. I wonder what the cops would say if they were called to the Planet Fitness. They might not agree with the PF policy.

Personal opinion. Personal perception.

I can also see it as lewd and lascivious behavior depending on what they are doing in there.

Yes, because we all know how lewd hanging up coats and purses are!

Technically if you're in the park and take off your coat with nothing underneath then yes!

No law for, no law against, or just no law one way or the other?
Specifically, I would consider a law of the following nature as being against (not saying there is one, this is just an example I dreamed up): "No male shall be allowed in a restroom or locker room designated for female use, nor shall any female be allowed in a restroom or locker room designated for male use. First offense shall be considered a misdemeanor and carry a fine of et cetera"

Depends on if that's just the excuse to get in there and peep.
