Would you expect her to sit quietly while it happened to anyone? Would you? The second you got wind that this was done in class, would you wait to see if it was your daughter who did it?

And that is why people have to sue to effect change and make people do the right thing. Which is why our court system is such a mess. You are putting the responsibility on the students to make the right thing happen instead of putting the responsibility on the school to DO the right thing in the first place.

They felt intimidated into it. We are, afteral, talking about young adults that if brought up properly learned to respect their elders. They were probably in such a state of shock when the topic was brought up they didn't know what to do.

Here's the problem. It becomes rape, abuse, whatever you want to call it whenever there is an abuse of power. ANYTIME that ANYONE feels that they don't have the right to say no for whatever reason then you now have a problem. When bosses expect sex and threaten your job if you don't comply that's harassment. These girls did not feel able to safely say no to the professor. That in itself makes it abuse. And abuse of authority. They were told if they didn't volunteer their grade would suffer. Well, the very definition of volunteer means to do it willing. These girls didn't do it willing. They did it because they were afraid they would fail the class if they said no. So there is an abuse of power. It clearly puts them on stable ground for a lawsuit. And it doesn't matter if a thousand women before them did it. THESE two didn't want to. That argument is as stupid as saying "Well, ALL my secretaries have given me blow jobs in the past." Just because they did in the past doesn't mean it's right.
