  • David Zink, 55, crashed into Amanda Morton, 19, on Interstate 44 in 2001 
  • He had just finished 20-year jail term, feared the crash violated his parole
  • Zink abducted Morton, took her to a motel, raped her, took her to cemetery
  • He laughed as he told police how he broke her neck and sliced her spine
  • Jury sentenced Zink to death in 2004. He is due to die at 6pm CDT Tuesday
  • Missouri Supreme Court rejected appeal, now it goes to US Supreme Court

A man convicted of raping a 19-year-old girl then tying her to a cemetery tree and killing her with his bare hands is fighting to block his execution scheduled for Tuesday evening.

David Zink, 55, had just completed a 20-year jail term in Texas for rape and abduction when he crashed into Amanda Morton on the Insterstate 44 in Stafford, St Louis, in 2001 and kidnapped her.

He laughed as he told police how he tied Morton to a tree, told her to look up, then snapped her neck and sliced her spinal cord with a knife. A jury deliberated for 90 minutes in 2004 before sentencing him to death.

 

 

Now, after the Missouri Supreme Court declined his appeal on Monday, Zink's case will appear before U.S. Supreme Court justices as his attorneys fight to spare him from execution at 6pm CDT.

A clemency request also was in the hands of St. Louis-based 8th U.S. Circuit Court of Appeals and Missouri Governor Jay Nixon.  

 

Zink had abducted Morton after hitting her car from behind on an Interstate 44 exit ramp a mile from her Strafford home. Morton was driving home after visiting a friend.

Police found Morton's Chevrolet Cavalier abandoned on the ramp with the keys in the ignition, the engine running and the headlights and hazard lights on. Her purse, credit card and medication were found inside the vehicle. 

Fearing that his drunken crash into Morton could violate his parole and send him back to prison, Zink initially abducted Morton, taking her to a motel.

After they left, the motel manager saw a televised news report about Morton's disappearance, recognized her as the woman who had checked in with Zink, and gave investigators Zink's name and license plate number.

Zink was arrested at his parents' home then led authorities to Morton's buried body in a cemetery.

He laughed as he told police that he had tied Mortin to a tree and told her to look up. When the bewildered Morton glanced skyward, Zink said, he snapped her neck.

Afraid she might regain consciousness, he admitted, he used a knife to sever her spinal cord at the neck and covered her body with leaves before getting a shovel from his home to bury her.  

 

'If I think that you're going to pose a threat to my freedom, it is set in my mind I want to eliminate you,' Zink says in his videotaped confession.

An autopsy later showed that Morton had eight broken ribs and 50 to 100 blunt-force injuries. Morton also had been sexually assaulted, with DNA evidence linked to Zink found on her body.

Jurors who convicted him found three aggravating circumstances that by law justified Zink's death sentence, including that the killing 'involved depravity of the mind and was outrageously and wantonly vile, horrible and inhuman,' the state Supreme Court has found.

Zink's appellate attorneys did not accept requests by The Associated Press for interviews Monday.

Phone and Facebook messages left Monday with Morton's mother and sister were not immediately returned.

Missouri has executed four men this year and 16 since November 2013. Only Texas has executed more inmates over that span.

Our appeals system takes too long.

Other countries will execute within weeks of conviction.

There are cases like this I think it should be that way here.

In the Abu Dhabi a muslim woman who killed an American woman in Dec 14, was put to death a couple of days ago. They didn't waste any time.  The families should not have to go through the horrors of what he did again and again.

How does this have anything to do with "liberals"? What do you suggest that "liberals" do different so that people like him don't kill? 

 

I don't have any daughters, but I have ALWAYS thought about the possibility of losing one of my children, since there are many ways young people can lose their lives.

DS2 was two buildings away from the World Trade Center when it was attacked. Thought a LOT about that fright for a long time ... still do.

Sick freaks like that, who admit to their misdeeds, should not get long appeals or delays of their sentences. The also shouldn't die peacefully by injection, their victims didn't die peacefully.

I  think they should donate 8 units of blood, then donate their organs, then be dumped in a field for the critters to eat. 

That's more productive than having them drawn and quartered. Doesn't require the use of 4 horses.

 Justice was served because a jury voted to give him the death penalty for his crimes.  It should have been carried out long before now, hence better late than never.

He was executed last night at midnight. I guess his appeal didn't go through. At least, this is what DH told me.
