Oh, for certain he absolutely does. But, the old saying "better the devil you know than the one you don't" comes into play here. Plus, for Obama to get a nomination approved by the Senate it would have to be a "Moderate". The upcoming President would be under no such limitation.

 The next president will probably not have a super majority in the Senate and will have to deal with the possible filibuster,  unless the the nuclear option is used.
