A mother has lost custody of her children after giving her seizure-prone daughter a smoothie laced with marijuana butter.

Kelsey Osborne, from Boise County in Idaho, says she has been 'torn apart' after her daughter Madyson, three, and her son Ryker, two, were taken from her by the Department of Health and Welfare.

The mother-of-two had given her daughter the smoothie to calm her down after she suffered a number of seizures and hallucinations.

However, the authorities saw this as irresponsible and have placed the children in the care of their father, leaving Osborne with supervised visits.

She told KBoi2: 'It's something that I'm going to fight for and I'm not going to give up until I have them back home where they have been begging me to be.

'I'm not going to stop. I won't stop. If it takes me two years, then it's going to take me two years.'

Marijuana butter is used for cooking and baking, as an alternative to smoking the drug. 

Medical marijuana is legal for ill children in Idaho, but only those who have been through a series of stringent tests.

The marijuana that is available to them is different to the form people take for recreational reasons.

Tom Shanahan, spokesman for the Department of Health and Welfare, said: 'The one they use for epilepsy doesn't have THC, it doesn't appear to have any kind of brain development issues. Recreational marijuana does cause that so it's not safe for these children.'

A petition has been launched to bring Osborne's children home, with 719 people signing up to pledge their support.

The petition needs 1,000 signatures before it can be sent to the Idaho governor, Butch Otter.

It says: 'Regardless of Idaho laws surrounding marijuana, a parent's responsibility is for the care, control, and the well being of their children.

'Idaho laws should reflect science and logic and not impede upon a parent's rights to choose what is best for their children.

'The Osborne case shows the failure of prohibition in Idaho and the need for reform of the archaic laws and CPS policies that prevent families from choosing a safer medical alternative for their families.

'Return the Osborne children to their mother, and change Idaho Marijuana laws/policy.'

Ummm, the child didn't have a prescription and the mother was just feeding her home grown style marijuana? And she sees nothing wrong with that?

Marijuana has been proven to effectively treat seizures.
Probably should ask a doctor before giving it to your toddler, though.

 Ya think?  And it IS available in her state if she goes through the tests. 

But, ok - give whatever amount you want to your kid.  

 

Hey - can't give a kid cold medicine, but marijauna?  Have at it!

Marijuana has been so stigmatized it's ridiculous.

There are ways of processing it and using it that gives you the benefits without the high.

Of course, go through the proper channels, doctors and such, but let's not throw out something that can help an awful lot of people.

Sounds like she is just trying to help her child. Of course she should do it under a doctor's supervision. But, if you are going to do it, just shut up about it. Say she picked up your smoothie and drank it. You don't run around and advertise it!

I mean how would anyone know what you are giving your kid unless you are stupid enough to tell them? I highly doubt they were testing her for THC. And, no i don't tell my pediatrician everything. When they used to ask if my kids were off the Pacifier, oh yeah yeah of course Doc. Blah, blah. It's none of their business.

I agree that she should have just kept her mouth shut. She should get the tests & go through a doctor's care but if it helps with the seizures I don't blame her for doing it on her own.
