Hmmmm...I'll be watching this one to see who wins.  My money is on the girl with the panic attacks, (although I disagree with that). But mental issues are the favored illness today...

Ohio State sophomore Madeline Entine suffers from panic attacks that can be severe enough to interfere with her daily activities and cause difficulty breathing. 

The student says her dog Cory knows when she is having an episode, meaning she has had fewer attacks.

However, Entine was told by the school that the pair had to move out of the house after sophomore Carly Goldman complained that Cory inflamed her allergies and in turn triggered her Crohn's disease.

Entine has now filed a lawsuit against the school under the Americans with Disabilities Act after administrators told her she must remove her service dog Cory from the Chi Omega sorority house because another student has complained.

'The panic attacks restrict her breathing ability and cause her to hyperventilate. They also cause her muscles to lock up and prevent her from walking on her own,' court documents obtained by CNN said.

Her certified therapy dog Cory is trained to lay on her stomach during an attack. Cory also helps her have fewer panic attacks, according to court documents.

'Cory's presence on Ms. Entine's torso helps relieve her panic attacks and restore her ability to breathe and move,' Entine's complaint says. 

A school official decided that both students were protected under the Americans with Disabilities Act, and the solution was to allow Goldman to stay because she signed up for her room first. OSU says they have used the same solution in other situations.

Entine filed a temporary restraining order against the university on October 26, allowing her to stay in the house with Cory while a federal judge makes a decision.

Goldman told the judge at a hearing last month that the dog's presence aggravated digestive issues that left her ill for weeks.

Cory is not allowed on the floor where Goldman lives, but she claims that because the dog is regularly played with by other members of the sorority, dander and hair are transferred to her room. 

The university offered to move either student to other housing, but they both refused.

It's a no win for the school. I think they tried to handle it fairly by letting the girl who had registered first have first 'dibs' and moving the other girl.

I think there may be more going on between the two girls though.

I would think the girl with the allergies might want to be the one to move since removing the dog will not remove the dander which lingers for about 6 months or so.

The girl with allergies should file for SSDI. Surely that is a disability too nowadays. Then, they can have a real standoff.

 I smell sarcasm in your post. If one is allergic they need to remove themselves from any situation that flares up their allergies or medicates.  SSDI is BS, not needed.

Special accommodations are made for food allergies, but not pet allergies. That's not fair, IMO.

I think the school's solution was the fairest, and it was already established policy. That's how it should have been decided.

A therapy dog or emotional support dog doesn’t have the same clout as a service dog around here.
I think the decision was unfair as well.

Eventually more and more people will find someone to call their pet a "therapy pet" and then landlords, etc will not be able to deny pets.

The only animals protected by the ADA are trained service animals. Some states have passed laws regarding fines for people trying to pass off emotional support or companion pets as service dogs.

I was in the board at my old condo. We ended up denying a veteran with two dogs because the one dog was way over the weight limit. Had he been a service animal we couldn’t have denied him but it was an emotional support dog.
Although it’s a catch 22 in Florida as there’s no licence issued for a service dog. The rule of thumb is don’t challenge the owner if the dog is behaving appropriately. But that’s another issue altogether lol.

I don’t think an emotional support animal should have the same
Protection as a service animal. I mean aren’t all pets for emotional support in some way?
